These Terms constitute a legally binding agreement between you and ExciteData Technical Solutions ("we," "us," or "our"). By accessing or using In-Sight Analytics, you represent that you are of legal age to form a binding contract and you have the authority to enter into these Terms.
If you are using In-Sight Analytics on behalf of an organization, you represent and warrant that you have the necessary authority to bind that organization to these Terms.
Subject to these Terms and the payment of any applicable fees, we grant you a non-exclusive, non-transferable license to use In-Sight Analytics for your internal business purposes.
You agree to use In-Sight Analytics in compliance with all applicable laws, regulations, and third-party agreements.
You may not copy, modify, distribute, sell, or sublicense In-Sight Analytics or any portion thereof without our prior written consent.
In order to use certain features of In-Sight Analytics, you may be required to create a user account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to provide accurate, current, and complete information when creating your account and to promptly update such information if it changes.
The use of In-Sight Analytics may be subject to payment of applicable fees. You agree to pay all fees and charges associated with your use of In-Sight Analytics in accordance with the pricing and payment terms provided to you.
All fees are non-refundable unless expressly stated otherwise in writing.
In-Sight Analytics and all related intellectual property rights, including but not limited to copyrights, trademarks, and trade secrets, are and shall remain the exclusive property of ExciteData Technical Solutions.
You shall not remove, alter, or obscure any proprietary notices or labels on In-Sight Analytics.
We respect your privacy and will handle your personal information in accordance with our Privacy Policy. By using In-Sight Analytics, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy.
To the maximum extent permitted by applicable law, we shall not be liable for any direct, indirect, incidental, consequential, special, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with your use of In-Sight Analytics.
Our total liability to you for any claims arising under or in connection with these Terms shall be limited to the amount actually paid by you for the use of In-Sight Analytics during the twelve (12) months preceding the claim.
We may terminate or suspend your access to In-Sight Analytics, in whole or in part, at any time and for any reason without prior notice or liability.
Upon termination, your right to use In-Sight Analytics will immediately cease, and you shall promptly cease all use of In-Sight Analytics and delete any copies in your possession.
These Terms shall be governed by and construed in accordance with the laws of South Africa. Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, or validity thereof shall be submitted to the exclusive jurisdiction of the courts located within South Africa.
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
These Terms constitute the entire agreement between you and ExciteData Technical Solutions regarding the subject matter herein and supersede any prior or contemporaneous agreements, communications, or understandings, whether oral or written, relating to such subject matter.
